Terms of Use

These Terms of Use ("Terms") are an agreement between you and Solid Foundation Software ("we," "us") governing your use of the PoshRelist app ("the app"). By downloading or using PoshRelist, you agree to these Terms. If you don't agree, please don't use the app.

1. What PoshRelist does

PoshRelist is a promo-campaign manager for Poshmark sellers. It lets you apply branded promotional overlays to your listing cover photos, preview the result, and revert to your original covers. PoshRelist is a tool you operate — you decide which listings to promote and when.

2. Your Poshmark account and responsibilities

PoshRelist is an independent app and is not affiliated with, endorsed by, or sponsored by Poshmark, Inc. "Poshmark" is a trademark of its owner.

• You sign in to Poshmark through Poshmark's own login, and you authorize PoshRelist to use that session to read your closet and, when you choose, to update your listing cover photos on your behalf.
• You are responsible for your Poshmark account and for ensuring your use of PoshRelist complies with Poshmark's own terms of service and policies.
• You are responsible for the promotional content and pricing you choose to apply to your listings.

3. Subscriptions and billing

PoshRelist is free to download and includes an optional auto-renewable subscription, PoshRelist Pro, offered on a monthly or annual basis. Pro unlocks features such as unlimited new promos, one-tap Poshmark apply and restore, all promo styles, editing live promos, and promo-end reminders.

• Price. The current price is shown in the app before you confirm a purchase, in your local currency.
• Payment. Payment is charged to your Apple ID account when you confirm the purchase.
• Free trial. If a free trial is offered, you won't be charged during the trial. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Auto-renewal. Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or cancel. You can manage or cancel your subscription any time in your Apple ID account settings on your device. Deleting the app does not cancel a subscription.
• Refunds. Purchases are processed by Apple and are subject to Apple's refund policies; we cannot directly issue refunds for App Store purchases.

4. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use PoshRelist on Apple devices you own or control, for your own use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where the law permits.

5. Acceptable use

You agree not to use PoshRelist to:

• violate any law or the rights of others, including Poshmark's terms;
• interfere with, disrupt, or attempt to gain unauthorized access to any system or account; or
• misrepresent listings or engage in deceptive sales practices.

6. Intellectual property

PoshRelist, including its design, styles, and software, is owned by Solid Foundation Software and protected by law. Your listing photos and content remain yours; applying a promo does not transfer any ownership of your content to us.

7. Disclaimers

PoshRelist is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted or error-free, or that it will produce any particular sales result. You are responsible for reviewing changes to your listings. We are not responsible for actions Poshmark takes on your account or for changes to Poshmark's platform.

8. Limitation of liability

To the fullest extent permitted by law, Solid Foundation Software will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, sales, or data, arising out of or related to your use of PoshRelist. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim.

9. Changes

We may update the app and these Terms from time to time. When we change these Terms, we'll revise the "Last updated" date above. Your continued use of the app after changes take effect means you accept the updated Terms.

10. Termination

You may stop using PoshRelist at any time by deleting the app. We may suspend or end your access if you materially breach these Terms.

11. Governing law

These Terms are governed by the laws applicable at Solid Foundation Software's principal place of business, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.

12. Apple App Store

PoshRelist is licensed, not sold, to you for use only under these Terms. The following applies to your use of the app obtained from the Apple App Store:

• These Terms are between you and Solid Foundation Software only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• Apple is not responsible for any product warranties, whether express or implied. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal/regulatory, or consumer-protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
